Now that makes sense SER8.

And I understand defamation is on the basis of balance of probabilities rather than beyond reasonable doubt.  So a successful defence in a criminal case (beyond reasonable doubt) on a matter of law does not automatically translate into a related civil matter (balance of probabilities). So harder to win or defend a civil matter than to defend a criminal one - a greater onus of proof. With the time, financial and emotional investment involved, Brett might not think pursuing damages is worth it given the inherent unpredictability of court decisions.
