The Saturday Telegraph has been told it will be alleged a woman was made aware of the post on Snapchat and immediately contacted police....'

The woman was unaware, non consenting to filming and was made aware by someone of being exposed on the ether.:eek:

This is now being convicted regularly in our Courts.

It may serve as a lesson to other players, but they are all required to attend NRL programs on behaviour :banghead:

The Leilua and Norman incidents were all consensual recordings but non consensual broadcasting :cool:

There’s nothing in the ‘official’ wording of the charge that precludes the situation I suggested.

People have jumped on the ‘posted on social media’ line to mean it was publicly broadcast on a ‘wall’ a la Facebook, missing the subtlety that Snapchat generally works a bit differently to that. There is also no mention of how the woman was ‘made aware’ of the post on Snapchat - she may have been sent the footage, or part thereof, by Fainu himself, or, as I also suggested, he may have sent it to a friend (or friends) who have tipped her off.

Undoubtedly, he’s done the wrong thing - but I’ll reiterate, it’s not the same end of the scale as posting revenge porn online for the whole world to see. The courts will be getting all the details on which to base a decision, and no doubt they’ll be aware of just how widely (or not) the recording was distributed. They’ll also be no doubt made aware of how the filming came to be done in the first place (ie was it a spur of the moment case of hitting record on the phone camera and leaving it beside the bed, or a hidden video camera stashed inside a wardrobe or roof cavity, indicating significant premeditation) - that’s why the courts will get to decide the punishment, not the public.

I’m not familiar with Snapchat and only occasionally go on Facebook so these things do esacpe me, but are you saying that after Fainu shared this video that it DIDN’T go public or viral and was only shared amongst a few? Or they WERE’NT able to promote it further to other sites or that site?

Even if that were the case I find it disgusting and can only imagine what others would think if it was one of our daughters.....it’s just NOT ON!

How would ANYONE of us feel if we were the innocent girl?

This isn’t a porn video, it’s a consensual act that was NEVER meant to be filmed and broadcast.

It still gonsmacks me that people don’t think it’s a big deal.....can anyone try and put yourselves in this girl shoes without the crude comments?

Or as another example,we’ve all been on hotel rooms. Who would want our bedroom activities filmed and put on a social media site?....not many of us I think....certainly not me.

While I’ll give the guy some slack until we know everything, it’s not looking too good for me.
 
I’m also gonna go out on a limb here and say there’s a good chance the club and/or NRL Integrity Unit have seen the actual charge sheet, statements etc and are better placed than Joe Public to decide whether allowing him to play is appropriate or not.

This may be the case, I am more concerned with why we would promote him to FG, knowing this was going to blow up.

This hurts the club via bad press, hurts the player by his increased public profile now he is an "NRL Star" and has more of the media attention, and probably hurts the female involved, due to his now enlarged profile and the increased media attention.
All for what ? A few games in a dead season.

Personally i don't think there is anything wrong with doing kinky stuff like videoing your sex session . Home sex tapes are very common these days. All you need is a camera an erection and the right lady that agrees to the exciting act .
It becomes an issue if your partner does not agree to be filmed or for the tape to be made public . Some woman liked to be filmed in the act and some like the exposure of the video and some don't .
Its common courtesy to ask your partner if they want to star in your next home movie ;)

You’ve kind of illustrated my point @manlywarringah - the way it’s being reported or talked about is as if it has been posted on a public website/forum, which isn’t how that particular social media platform works/is used.

Your hotel room example also relates to another point I made - there’s a difference between stashing hidden cameras in wardrobes, roof cavities or whatever, and a spur of the moment decision to hit record on your smartphone camera and leave it on the bedside table.

Nobody has suggested he hasn’t done the wrong thing, at all. But there are degrees (of premeditation, harm done etc) that affect the penalties under the law, just like there are degrees of assault charges, for example. All I’m saying is, the club and the NRL are presumably aware of where this falls on the spectrum and have made decisions accordingly.

I’m also hesitant to judge what another generation considers to be on the spectrum of acceptable behaviour against my own standards. Social media is a massive one where what my parents think and what I think is acceptable varies (in some cases greatly) from what even my own younger siblings do online, let alone a further generation removed from that.

I accept what you say and I’m definitely not up on social media to know what can go public or not. I’m just not sure if what he did meant it could go to anyone down the line and end up everywhere.

We’ll all know more as it comes out and given our club has now given the kid a bigger profile due to promoting him to first grade, I’m sure we’ll all hear about it.

Without condoning anything and as you know yokahontas (prob your real name) but for those who don't, snapchat was designed to delete what ever message was sent through it after 10 seconds or a single viewing.

But well, so often things with 'willies' will find a way around such trifling matters. Screen shot for one.
 
Exactly. Because - here’s the thing - two lines in a news article don’t tell the full story. We have bugger all information about what has actually happened, what was filmed, and who it was sent/shown to.

Some of the knee jerk reactions would be appropriate if he’d been caught, say, stashing hidden cameras in someone’s bedroom, then putting the footage on Pornhub.

At the other end of the scale - and we don’t know that this isn’t what happened - two things explicitly stated in the article are that the young lady and Fainu are known to each other, and that whatever was filmed was transmitted via Snapchat. I don’t use Snapchat myself, and I know it can be used to send group messages, but most people I know use it for direct, person-to-person video/picture messaging. Consider the possibility that the victim in this case is/was his girlfriend (or a regular friend with benefits, whatever, entirely their business) he’s thought it would be amusing/arousing to film their consensual encounter (another point explicitly stated in the news report), and has sent the footage to the young lady in question at some later point, which she has then been duly disgusted and horrified by, and reported to police. There’s every chance the footage in question was not seen by any third party (yes, there’s also every chance it was the 21st century version of bragging to your mates at the pub about the hot chick you shagged, and it’s been sent to said mates).

My gut feeling, based on the few details known, is this looks to be much closer to the ‘stupid teenager doing something regrettable on the spur of the moment’ end of the spectrum, rather than the ‘reprehensible sexual deviant/predator’ end. I guess we’ll see.

I don't get that the integrity unit knew yet still passed him fit enough to play ?
Just imagine if Fainu was selected to play in the SOO series with this " violation upon woman" (supposed) incident hanging over his head ?
Would the integrity unit still permit him to play ..? No way ,it wouldn't matter how you rationalized it 80k pairs of eyes looking on plus home viewers, plus sponsors, plus media the only logical thing to do in that situation, should be the same in our situation stand him down pending an investigation........simple really.
Otherwise in both scenarios you would really have an elephant in the room story.
